FREQUENTLY ASKED QUESTIONS

1. What is the current status of the CFTC enforcement action against Fundsz?

On August 2, 2023, Melanie E. Damian was appointed Receiver over Fundsz and the assets of certain individuals operating a cryptocurrency trading scheme through Fundsz (the "Fundsz Estate"). Attached under the Court Documents tab of this website is the Statutory Restraining Order appointing the Receiver and the Receiver's First Status Report providing a complete update of the current status of this receivership case, including the Receiver's efforts to recover assets for the benefit of Fundsz's investors. 

 

2. When will I recover the funds I invested in Fundsz?

At this time, the Receiver is focused on locating and recovering assets for the benefit of all defrauded creditors of the Fundsz Estate.  In the future, the Receiver will conduct a claims process allowing all potential creditors to submit a proof of claim with supporting documentation showing their losses. The Receiver will then review all claims and make a determination as to whether claims should be approved for distribution. All claims will require Court approval as well. After receiving Court approval and authorization to make a distribution, the Receiver will make a distribution to all creditors holding approved claims. The amount of the distribution will be based on the cash on hand in the Fundsz Estate at that time. You will receive notice of the claims process by email well before the process begins.  At this time, the Receiver cannot estimate when the claims process will begin.

 

3. What can I do now to preserve my claim against the Fundsz Estate?

Please save all screenshots of your Fundsz account pages, receipts for transfers of cryptocurrency or any other form of payment to Fundsz, credit card and bank statements showing payments to Fundsz, and any other documents showing your communications with Fundsz and the status of your Fundsz account. All documentation in your possession or that you can request from your cryptocurrency platform, bank or credit card companies, will be helpful during the claims process.
